These Terms of Service ("Terms") govern your use of the website thesurgerydunedin.com (the "Site") and any purchases you make through our online store. The Site is owned and operated by Collins Kelly Plastic Surgery Ltd (NZBN 9429050957460), trading as The Surgery Dunedin ("we", "us", "our").

By using the Site or purchasing products through it, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About this Site

The Surgery Dunedin is a medical practice operated by Dr Anne Collins, a registered medical practitioner specialising in plastic, reconstructive and aesthetic surgery. This Site exists to provide general information about Dr Collins, her practice, the procedures she offers, and to sell skincare products through our online store.

2. Medical information disclaimer

The information on this Site is provided for general educational and informational purposes only. It is not medical advice and is not intended to be a substitute for professional medical consultation, diagnosis, or treatment.

Plastic, reconstructive and aesthetic surgery is a complex and evolving field. While we make reasonable efforts to keep the information on this Site accurate and current, methods of diagnosis and treatment change as new knowledge and techniques become available. Information on individual pages may not always reflect Dr Collins' current clinical thinking.

General information on this Site cannot account for your individual circumstances, medical history, or specific needs. Before deciding on any surgical procedure, you must have a formal consultation with Dr Collins to discuss your unique needs, alternative treatment options, risks, and potential complications.

3. Surgical outcomes

The outcomes of any surgical procedure vary from person to person. Recovery is influenced by many factors that are unique to each patient and cannot always be predicted.

Any photographs, testimonials, or case examples shown on this Site are illustrative only. They cannot be relied on as an indication of the results you personally can expect. We make no guarantees about the outcome of any specific procedure.

4. Online store

4.1 Products

Our online store sells skincare products. All product descriptions, images, and prices are provided in good faith and we make reasonable efforts to ensure they are accurate. Minor variations in product appearance or packaging may occur.

4.2 Pricing and payment

All prices are listed in New Zealand Dollars (NZD) and include GST. Shipping costs (if any) are shown at checkout before you complete your purchase.

We accept payment through Shopify Payments, which includes major credit and debit cards and Afterpay. Payment is processed by our payment provider and we do not store your full payment details.

We reserve the right to correct any pricing errors on the Site. If a pricing error is identified after you have placed an order, we will contact you to either confirm the corrected price or cancel and refund the order.

4.3 Orders

Your order is an offer to purchase. We are not obliged to accept any order and may decline an order at our discretion (for example, if a product is out of stock, if we suspect fraud, or if there has been a pricing error). If we decline your order, we will refund any payment you have made.

4.4 Shipping

We ship within New Zealand only. We do not currently ship internationally.

Shipping times, methods, and costs are shown at checkout. While we make reasonable efforts to dispatch orders promptly, delivery times are estimates only and we are not responsible for delays caused by our courier or other third parties.

Risk in the products passes to you on delivery.

4.5 Returns and refunds

Faulty or damaged products: If a product you receive is faulty, damaged, or not as described, please contact us at hello@thesurgerydunedin.com within a reasonable time of receiving it. We will arrange a replacement, refund, or other remedy in accordance with your rights under the Consumer Guarantees Act 1993.

Change of mind: We are not required to provide a refund or exchange if you change your mind about a product. However, at our discretion, we may accept returns for change of mind where the product:

• Is returned within 14 days of delivery
• Is unopened, unused, and in its original sealed packaging
• Is accompanied by proof of purchase

Return shipping for change-of-mind returns is at your cost. We will refund the purchase price (excluding original shipping costs) once we have received and inspected the returned product.

Nothing in this policy limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

5. Use of the Site

You may use this Site for lawful purposes only. You must not:

  • Use the Site in any way that breaches any applicable law or regulation
  • Attempt to gain unauthorised access to the Site, its server, or any connected systems
  • Introduce viruses, malware, or other harmful material to the Site
  • Use the Site to transmit unsolicited commercial communications
  • Use any automated system (including scrapers, bots, or spiders) to access the Site without our prior written consent
  • Copy, reproduce, or republish any part of the Site except as permitted under section 6

All content on this Site, including text, images, photographs, graphics, logos, design elements, and the underlying code, is owned by Dr Anne Collins or used under licence, and is protected by New Zealand and international copyright laws.

You may view, download, and print pages from the Site for your own personal, non-commercial use. You may not otherwise copy, reproduce, modify, distribute, publish, or commercially exploit any content from this Site without our prior written permission.

The trade marks, logos, and trade names displayed on the Site are owned by us or our licensors. Nothing on the Site grants you any right or licence to use them.

7. Third-party links

The Site may contain links to third-party websites. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content of any third-party site, and your use of those sites is at your own risk and subject to their own terms.

8. Security and your responsibilities

We use commercially reasonable measures to keep the Site secure. However, no internet transmission is completely secure, and we cannot guarantee the security of information transmitted to or from the Site.

You are responsible for taking reasonable steps to protect your own systems, including using up-to-date antivirus software and keeping your devices and accounts secure.

9. Limitation of liability

To the maximum extent permitted by law:

• The Site and its content are provided "as is" and "as available", without warranties of any kind (express or implied), except for any warranties that cannot be excluded under New Zealand law.

• We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

• To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive loss or damage arising from your use of (or inability to use) the Site, including any loss of profits, data, goodwill, or business opportunities.

Consumer Guarantees Act: If you are acquiring goods or services from us as a consumer (as defined in the Consumer Guarantees Act 1993), nothing in these Terms limits or excludes any rights, remedies, or guarantees available to you under that Act or any other applicable consumer protection legislation.

Business use: If you are acquiring goods or services from us for the purposes of a business, you agree that, to the extent permitted by law, the Consumer Guarantees Act 1993 does not apply.

Nothing in these Terms excludes, restricts, or limits any liability that cannot lawfully be excluded, restricted, or limited under New Zealand law.

Our handling of your personal and health information is governed by our Privacy Policy, which forms part of these Terms.

11. Changes to these Terms

If you have placed an order, the Terms in effect at the time of your order will apply to that order.

These Terms are governed by the laws of New Zealand. Any dispute arising out of or in connection with these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of New Zealand.

13. General

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other.

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Site.
